Terms and conditions
ParkPrivate ApS would like to make sure that all users of Visitors have a positive experience. Therefore there are some rules and regulations that apply for the use of Visitors. These rules and regulations are outlined below and they are automatically accepted by you, when registering as a user.
1. Applicable for all users
User registration
You register as a user of the Visitors app by firstly downloading it from the App store or Google Play.
When you register as a user, you need to provide the following personal information:
- Phone number and Apple ID or Google account
- Name (optional)
The information regarding the phone number will be accessible for Firebase. ParkPrivate ApS uses Firebase in order to log you in as a user. Your name will only be used if you are in need of customer service.
Parking Groups
There are different types of parking groups, users are able to become members of, depending on the type available in the different municipalities.
- The free group:parking groups, where everyone can become members and use the parking spaces for free.
- The subscription group:parking groups where members pay a monthly subscription fee to be a member. As a member of this group, you can use all the parking spaces of the group with no further fee. Read more in section 2.
- The owner’s association group:parking groups where residents in an owner’s association can register as users and help each other with parking for guests. Read more in section 3.
- The parking license group: parking groups where a valid residence parking license is required in order to use the parking areas within the group. Read more in section 4.
Entry requirements
Some parking groups have an entry requirement before you as a user can become a member (for example: a residence parking license, certification code, customer number, student number, telephone number or email etc.) In most cases a user is automatically approved, provided that the validation code entered is valid. In other instances the administrator of the group will make the decision to accept or reject the request for membership.
Parking spaces
A parking group provides access to the use of a number of different parking spaces. The parking spaces within the parking group can be placed in many different locations or all be at the same location.
Times of use of the parking spaces
The parking spaces in a parking group can have different periods of time where you are able to use them. The specific time you can use a parking space within a group is specified in its description in the app.
Use of the parking spaces
All of the parking spaces in a group are to be shared among the members of the group. This means that you are not allocated a specific parking space, but rather are able to use any parking space within the area specified in the description in the Visitors app. Therefore parking spaces are shared on an equal footing with the other members of the group. No member has priority, parking spaces are allocated on the first-come first-served principle. There is no guarantee that a parking space is available for booking in the specific time period you may wish to book one. All parking spaces may be occupied by other members of the group.
Booking of a parking space
It is possible to book/reserve parking spaces in advance in most parking groups.
If you book a parking space where an authorized parking company carries out supervision and control, you must provide us with the following information about the car:
- The car’s license plate number (vehicle registration number)
The license plate number will be passed on to the authorized parking company, which supervises and controls the parking space, so that they can check that a valid parking permit has been created for the registration number in question. ParkPrivate ApS is not responsible for the user entering the correct registration number (license plate) when booking the parking space or registering in the app.
If you book a parking space that requires payment, you must provide us with the following information about your payment card.
- Card number
- Expiration date
- 3-digit security code
Payment card information is passed on for processing to Stripe Inc, which uses the information when a transaction is completed.
Digital parking permit (receipt)
When you book a parking space, you receive a digital parking permit/receipt in the app. This is your proof that you have a valid permit to stay in the specific parking area during the booked time period. The receipt appears automatically after the booking has been completed and is always available under the menu item ‘my parkings’.
Technical issues / not having a digital parking permit (receipt)
If technical issues arise during the booking process, such as a lack of internet access, this may mean that the booking cannot be completed, which means that the booking cannot be made and therefore the digital parking permit (receipt) is not obtained. In this case, the user has not obtained the right to park in the parking space and may risk a parking fee, if the user chooses to park in the parking space regardless. ParkPrivate is not responsible in this case and cannot be held responsible for the inconvenience it causes, when a parking permit (receipt) is not obtained for whatever reason.
Parking without a permit
If you park in a Visitors parking space without a valid digital parking permit (booking receipt), you may risk getting a parking fee in the amount stated in the local parking regulations pertaining to the parking area.
Limitations to number of bookings
There can be limitations to how many bookings you are able to make at a time, within a parking group. This is a way to regulate usage, so that no single member can get the feeling that they have their own private parking space. The restriction ensures that all members of the group can benefit from the parking spaces. The intention behind these parking spaces is for the shared benefit of the parking group members!
The limitations to the number of bookings at a specific parking space is mentioned in the description of the parking area and will appear as soon as a user is about to exceed the number of bookings possible.
Limitations to booking length
There can be limitations to how long a booking can be and how many hours a group member can book a parking space for, at a time. This is a way to regulate usage, so that no single member can get the feeling that they have their own private parking space. The restriction ensures that all members of the group can benefit from the parking spaces.
Any limitations to the booking length possible at any specific parking space will appear as soon as a user selects the desired length of the booking.
Time booked
When you book a parking space through Visitors, you need to book a minimum of 30 minutes. If you would like to make a booking lasting longer than 30 minutes, you are also able to book in 15 minute intervals, eg. 45 minutes, 60 minutes and 75 minutes.
Right of withdrawal
As a user and group member you have the possibility of canceling your Visitors booking.
If you have paid an hourly price for the booking you may be able to get your payment back by canceling the booking. Whether you can get your payment refunded is dependent upon how long there is until the booking starts.
Refunded money will be transferred to your Visitors account and can be used as payment for future bookings. It appears under the menu item ‘profile’..
Below you can see how much is refunded under which circumstances:
- >24 hours before: 100% refunded. It will cost you nothing to cancel your booking and you will not be charged any payment for the booking. ParkPrivate ApS will transfer the full amount to your Visitors account and the money can be used for future bookings.
- 2-24 hours before: 50% tilbageføres. Du bliver debiteret 50% af bookingen. ParkPrivate ApS overfører de resterende 50% til din Visitors-konto som tilgodehavende.
- < 2 hours before: 0% refunded. You will be charged the full payment for the booking.
Account balance
Any money you may have in your Visitors account through ParkPrivate ApS cannot be demanded transferred to your personal bank account.
Personal liability
Entry to and use of parking spaces is at your own risk and in accordance with ParkPrivate ApS’ rules and regulations for use of Visitors and any guidelines posted in the specific parking area. Neither ParkPrivate ApS nor the owner of the parking space can be held liable for accidents, theft, damage to persons, vehicles, valuables and the like, for whatever reason. Likewise, ParkPrivate ApS cannot be held liable for indirect losses or any consequential damages. These rules apply unless something else is stated in non-negotiable legal rules within the Danish law.
The parking space is occupied
If, contrary to expectations, it is not possible to park during the booked time, because there are no available parking spaces within the allocated area, it is because one or more vehicles are illegally parked.
ParkPrivate ApS is not responsible for this or the inconvenience it causes.
The parking space is unavailable due to weather conditions etc.
If parking in a booked parking space is not possible or delayed due to unforeseen weather conditions over which ParkPrivate ApS has no control, including - but not limited to - snow, ice, fallen leaves, branches etc. ParkPrivate ApS cannot be held responsible.
Parking behind a barrier, boom or gate
If you have booked a parking space which is located behind a barrier, boom or gate (eg. a parking garage), ParkPrivate ApS cannot be held responsible if access to the parking space is not possible, as a result of, for example, technical problems with a barrier or gate. This is the case before, during and after the booking ends.
Force majeure
If parking in a booked parking space is delayed or not possible, due to unforeseen circumstances (force majeure) over which ParkPrivate has no control, including - but not limited to - war, mobilization, a pandemic, terrorist actions (including threats), fire, strike, boycott or blockage, lockout, hacking, closure of roads or access to the parking space and or natural disasters, ParkPrivate cannot be held responsible.
Law and venue
Any dispute that may arise in connection with terms and conditions of sales and delivery, must be settled according to Danish law.
If disagreements cannot be resolved amicably, any dispute must be settled by arbitration. The arbitration court is located in Aarhus within postal code: 8000-8260. The Arbitration Act Law applies.
Parking fine
If you have received a parking fine, this must be paid directly to the operator who imposed the fine. The operator is an independently acting third party, therefore ParkPrivate ApS cannot be held responsible for any action by them.
Right of complaint
If you wish to make a complaint about a booking, you can contact ParkPrivate ApS either by sending an email to info@visitors.dk or by calling + 45 71 89 00 07.
If you wish to make a complaint regarding a parking fine, you must directly contact the operator who issued the fine - the operator’s contact information will appear in the printed parking fine, which is either placed on your car or sent to you.
GDPR
ParkPrivate ApS will save user information on our servers in accordance with the GDPR regulation and the Danish law on personal data ‘Persondataloven’.
Cookies
When visiting http://www.visitors.dk information (so called cookies) will be registered about your visit to the site.
Changes
ParkPrivate can at any time make changes to the above mentioned terms and conditions. The applicable terms and conditions at any time are available on the website.
2. For subscription groups
When registering for a Visitors group that requires a monthly subscription, you must provide us with the following information about your payment card:
- Card number
- Expiration date
- 3-digit security code
Payment card information is passed on to Stripe Inc. for processing, which uses the information when the monthly subscription transaction is being completed.
Membership
Your Visitors membership will continue until terminated. To use the Visitors service you must have access to the internet and a Visitors compatible device. Furthermore, you must provide a payment method. It must be a current, recognized and valid payment method, which can be updated at any time and may include payment through a third party. Unless you cancel your membership before the billing date, ParkPrivate ApS will charge the membership fee for the following billing period through the specified payment method (see ‘unsubscribe’ below).
Free trial period
Your Visitors membership may start with a free trial. The duration of the free trial of the membership will be indicated during registration and is intended to allow new members to try the service.
Visitors makes the final decisions regarding if the conditions for a free trial period is met, and we may limit access to or the duration of free trial periods, to prevent misuse. We reserve the right to cancel free trial periods if we assess that they are being misused or if the conditions are not being met.
We will charge you the membership fee for the following billing period via your payment method at the end of the free trial period, unless you cancel the membership before the end of the free trial period.
Billing
The billing period is typically monthly and is always prepaid. We will invoice you for the membership fee for the Visitors service via your payment method specified under the ‘manage subscription’ page. The length of your billing period is typically one month, starting from the date the trial period ends, or from the date you sign up for a Visitors subscription group that is not covered by a free trial period. In certain instances the billing date may change, e.g. if a payment has not been completed or if the paid subscription membership began on a date that does not exist in a given month. Click ‘manage subscription’ under the profile page in the Visitors app to see your receipts.
Payment methods
To use the Visitors service you must provide one or more payment methods. When you have provided us with a payment method, we are authorized to collect payments using any payment method associated with your account, in the event that your primary payment method is declined or is no longer available to us for payment of your subscription fee. You are liable for any owed unpaid amounts. If payment cannot be completed due to card expiration, insufficient funds or otherwise, and you do not delete your account, we may suspend your access to the service until we have collected the payment through a valid payment method. With some payment methods, the issuer may charge you certain fees in the connection with the processing of the payment method. Local fees may vary depending on the payment method used. Please contact the issuer of the payment method for further information.
Updating your payment methods
You can update your payment methods by going to the ‘payment’ page in the app. We may also update your payment methods with information provided by your payment service providers. When you make an update to your payment methods you provide us with permission to continue charging payment via the relevant payment methods.
Unsubscribe
You can cancel your Visitors membership at any time. You will continue to have access to the Visitors service until the end of your billing period. Subscription payments will not be refunded and we do not provide refunds or credits for partially used membership periods. To unsubscribe, go to the section ‘manage subscription’ in the app and press ‘unsubscribe’ and then follow the instructions. If you cancel your membership, your account will automatically be closed at the end of the current billing period.
Changes to prices and subscriptions
We may make changes to our subscriptions and the price of them occasionally. However, price changes or subscription changes will not apply until 30 days after you have been notified hereof.
Changes to the number of parking spaces available and their times of use
ParkPrivate ApS has the right to change the number of parking spaces available in a parking group at any time, just as the times of use for any parking area can be adjusted according to the wishes of the owner. ParkPrivate Aps also has the right to change the number of parking locations in any group. However, major changes will not apply until 30 days after you have been notified.
Closure of a parking group
ParkPrivate ApS has the right to close a parking group at any time. In the event of the closure of a parking group, members of the group will be informed at least 30 days before its implementation. If, on the date of the closure of the parking group, you have a receivable, this will be returned to you.
3. For owners associations
Rental of parking spaces in owner associations
Information about the guest who will be staying in the parking area.
When you book a parking space for a guest through Visitors and thereby provide us with information about this guest, you confirm that you have received consent from this guest and that you have received consent to forward their information. The only information that you need to provide ParkPrivate ApS about the guest is the following:
- Name
- Telephone number
- The cars registration number (license plate), which is only required when control of the parking area is carried out by an authorized parking operator.
Information about the guest’s phone number will not be forwarded to any third party. The phone number will only be used to send the electronic parking permit to the guest’s phone.
Information about the registration number (license plate) of the guest’s car is sent to the owner of the parking space. If an authorized parking company oversees the parking area information about the car’s registration number (license plate) will be forwarded to them.
Price for parking
The owner of the parking area determines the hourly price for their parking spaces. The hourly price can be set at different amounts depending on the time of day and can also be 0 Danish kroner.
The prices are listed in Danish kroner incl. VAT, ParkPrivate ApS reserves the right to correct any price errors, price changes and update errors.
If the guest collects the car before the end of the booking, you will not receive a refund for the period when the parking space is not used.
Responsibilities of those in charge of rental of the parking area
It is the responsibility of those in charge of rental of the parking area to make sure that the parking spaces that have been rented are standing empty and ready for use during the time periods they have been rented.
Time booked
When you book a parking space through Visitors, you need to book a minimum of 30 minutes. If you would like to make a booking lasting longer than 30 minutes, you are also able to book in 15 minute intervals, eg. 45 minutes, 60 minutes and 75 minutes.
When booking, you receive a digital receipt in the Visitors app and your guest receives a text message with confirmation and a parking permit.
If the parking area owner cancels the booking
If the owner of the parking space is forced to cancel the booking, you will be refunded the amount paid for the canceled booking.
Online payment
We securely store your payment information at ParkPrivate ApS to make your future bookings faster. Money is only withdrawn when you make a booking.
For those renting out parking spaces in owner associations
Registering to rent out parking spaces
When you register you must provide us with the following information about you, your parking space and your bank account:
- Name
- Telephone number
- Details of your parking space: - Address, photo, parking space number and description.
- Payment method information: - Bank registration number - Your bank account number
We store this information on our server in accordance with current legislation regarding GDPR and The Personal Data Act. The information will not be passed on to third parties.
Price for parking
As the one renting out one or more parking spaces, you set the hourly price for your parking space. You can also set the price differently at different times of the day.
Payment of rental income
Your rental income is paid to your account on the first working day of a month.
Service fee
ParkPrivate ApS charges a service fee for every booking above 0 Danish kroner, made through Visitors in order to maintain our system. The service fee is 20% of the rental income, however, a minimum of 3 Danish kroner per rental. This service fee is charged from the rental income automatically. ParkPrivate ApS will pay the fees associated with this transaction.
Free passage
When you rent out one or more parking spaces, you are responsible for ensuring that there is free passage to your parking space when it is rented out. This means, for example, that the parking area is kept clean and in winter it must be free of snow and graveled/salted. You, as the one renting out a parking area, are responsible for this being done in accordance with the orderliness proclamation No. 511 of July 20th 2005.
Parking without a permit
If you do not have outsourced parking control over your parking area, it is your responsibility to keep track of whether the car(s) parking in your parking area have a permit to do so.
If you already have parking control of your parking area or choose to have it outsourced to business partners, the one renting/the guest may risk a parking fee if parking is done without a valid permit, corresponding to the amount mentioned on the signs in the parking area.
You are not allowed to use the parking space yourself, during the time periods where it is rented out through Visitors, even when it is not yet booked. If it is not set for rental, you are of course free to use the parking space as you wish. Parking in your own parking space while it is rented out to through Visitors, even when it is not booked, can result in you getting a parking fine.
The issuing of parking fines is done by the authorized parking company that supervises the area. In this case, we pass on relevant information to the from your registration as a rental parking owner to the authorized parking company.
Cancellation
If no bookings are made for your parking space(s), you can always choose to cancel your rental parking registration with Visitors. If your parking space(s) has any future bookings, the registration of your parking space(s) will only be canceled after the last booking has been completed.
If you want your rental parking registration with Visitors to be canceled despite future bookings, you should contact Visitors customer service. The possibilities for cancellations through customer service and any related costs are listed below:
- Parking rental can at any time be canceled, if no future bookings are made for the parking space(s).
- If there are future bookings for the parking space(s), at the time you wish to cancel, the cancellation will go through as soon as the last already existing booking has been completed.
- If you wish to cancel your rental parking registration despite there being future bookings for your parking space(s), it can be done with a 200 danish kroner fee pr. already existing booking that is canceled. In this instance you need to get in contact with Visitors customer service. ParkPrivate ApS will then send you an invoice with the amount in question. When the invoice has been paid your registration will be canceled.
Rental time period
When your parking space(s) is made available for rental, it needs to be available for a minimum of one hour.
Right to oversee
When you rent out your parking space(s) through Visitors, it is your responsibility to make sure that you oversee and have control over the parking space, as well as have permission to rent it out.
Rental
When your parking space(s) is set for rental through Visitors, the parking space(s) must not be rented out through any other rental services at the same time.
Tax
As the one renting out your parking space(s), you are responsible for reporting any relevant information to taxation authorities about your rental income.
Cooperation with parking operator
ParkPrivate ApS can ensure that a collaboration is established with an operator who can supervise the parking space(s) and provide signage, if you wish. It is not a requirement that you cooperate with a parking operator on site to use Visitors for renting out your parking space(s). You can use Visitors in all types of parking spaces.
4. For parking groups where a residents license is needed
Scan of license plates
During entry and exit of a parking garage/ parking area cameras may be used to scan the cars license plate (registration number). The scan will be used to verify that a valid booking has been made, for the car in question, in the Visitors app.
If a valid booking is made for the car with this license plate, the boom barrier will automatically open. This is only if the car arrives within the booked time period.
If the car leaves the parking garage/parking area within the time period of the booking, the boom barrier will automatically open. If the car leaves the parking garage/parking area after the booking has ended, payment for the extra time will need to be paid. Payment will occur after you get in contact with the service center of the parking garage/parking area, who will then calculate the time that has exceeded the booking. You will then have to pay the remaining amount before exit of the area with the car is possible.
Any Visitors user who may abuse the system of a parking garage/basement will be banned from any future use.
The license plate scanning cameras are provided and operated by third parties. ParkPrivate ApS is not responsible for the digital validation process carried out through the cameras.
Arrival before a Visitors booking begins
If a user arrives at a parking garage/parking area where payment can be made with Easypark, and the user has made a Visitors booking, the user must be aware of the following:
- If the user arrives before the start of the Visitors booking, and has activated ‘automatic camera parking’ in the Easypark app, the gate/barrier to the parking garage/parking area will open automatically. This will result in the user activating a paid parking in Easypark and thus paying for the entire parking, which is automatically paid, when the user exits the parking garage/parking area.
- The same applies, if a user arrives at the parking garage/parking area before the Visitors booking begins and chooses to insert their payment card into the maschine in order to have the boom barrier/gate open. In this case a paid parking is activated and the user will have to pay for the entirety of the parking.
To ensure that it is the user’s Visitors booking that is used, the user must arrive after the Visitors booking has begun. efter Visitors bookingens starttidspunkt.
ParkPrivate ApS is not responsible if a user arrives at the parking garage/parking area before the beginning of a Visitors booking and thus activates a paid parking via Easypark’s ‘automatic camera parking’ function or via payment card. ParkPrivate ApS does not provide compensation for paid parking caused by premature arrival at the parking garage/parking area.
