Terms and conditions

ParkPrivate ApS would like to make sure that all users of Visitors have a positive experience. Therefore there are some rules and regulations that apply for the use of Visitors. These rules and regulations are outlined below and they are automatically accepted by you, when registering as a user.

1. Applicable for all users

User registration

You register as a user of the Visitors app by firstly downloading it from the App store or Google Play.

When you register as a user, you need to provide the following personal information:

  • Phone number and Apple ID or Google account
  • Name (optional)

The information regarding the phone number will be accessible for Firebase. ParkPrivate ApS uses Firebase in order to log you in as a user. Your name will only be used if you are in need of customer service.

 

Parking Groups

Der er to typer af parkeringsgrupper, man som bruger af Visitors kan tilmelde sig. Det er kommunalt besluttet, hvorvidt de pågældende p-pladser kan benyttes af alle, eller kun borgere med beboerlicens til det pågældende område.

  • Gratis gruppe: Er parkeringsgrupper, hvor alle kan tilmelde sig og bruge p-pladserne gratis.
  • The parking license group:  Er parkeringsgrupper, hvor det kræver en beboerlicens for at anvende p-pladserne i gruppen. Læs mere i afsnit 2.

 

Entry requirements

Some parking groups have an entry requirement before you as a user can become a member (for example: a residence parking license, certification code, customer number, student number, telephone number or email etc.) In most cases a user is automatically approved, provided that the validation code entered is valid. In other instances the administrator of the group will make the decision to accept or reject the request for membership.

 

Parking spaces

A parking group provides access to the use of a number of different parking spaces. The parking spaces within the parking group can be placed in many different locations or all be at the same location.

 

Times of use of the parking spaces

The parking spaces in a parking group can have different periods of time where you are able to use them. The specific time you can use a parking space within a group is specified in its description in the app.

 

Use of the parking spaces

All of the parking spaces in a group are to be shared among the members of the group. This means that you are not allocated a specific parking space, but rather are able to use any parking space within the area specified in the description in the Visitors app. Therefore parking spaces are shared on an equal footing with the other members of the group. No member has priority, parking spaces are allocated on the first-come first-served principle. There is no guarantee that a parking space is available for booking in the specific time period you may wish to book one. All parking spaces may be occupied by other members of the group.


Booking of a parking space

It is possible to book/reserve parking spaces in advance in most parking groups.

If you book a parking space where an authorized parking company carries out supervision and control, you must provide us with the following information about the car:

  • The car’s license plate number (vehicle registration number)

The license plate number will be passed on to the authorized parking company, which supervises and controls the parking space, so that they can check that a valid parking permit has been created for the registration number in question. ParkPrivate ApS is not responsible for the user entering the correct registration number (license plate) when booking the parking space or registering in the app.

 

 

Digital parking permit (receipt)

When you book a parking space, you receive a digital parking permit/receipt in the app. This is your proof that you have a valid permit to stay in the specific parking area during the booked time period. The receipt appears automatically after the booking has been completed and is always available under the menu item ‘my parkings’.

Technical issues / not having a digital parking permit (receipt)

If technical issues arise during the booking process, such as a lack of internet access, this may mean that the booking cannot be completed, which means that the booking cannot be made and therefore the digital parking permit (receipt) is not obtained. In this case, the user has not obtained the right to park in the parking space and may risk a parking fee, if the user chooses to park in the parking space regardless. ParkPrivate is not responsible in this case and cannot be held responsible for the inconvenience it causes, when a parking permit (receipt) is not obtained for whatever reason.

 

Parking without a permit

If you park in a Visitors parking space without a valid digital parking permit (booking receipt), you may risk getting a parking fee in the amount stated in the local parking regulations pertaining to the parking area.

 

Limitations to number of bookings

There can be limitations to how many bookings you are able to make at a time, within a parking group. This is a way to regulate usage, so that no single member can get the feeling that they have their own private parking space. The restriction ensures that all members of the group can benefit from the parking spaces. The intention behind these parking spaces is for the shared benefit of the parking group members!

The limitations to the number of bookings at a specific parking space is mentioned in the description of the parking area and will appear as soon as a user is about to exceed the number of bookings possible.

 

Limitations to booking length

There can be limitations to how long a booking can be and how many hours a group member can book a parking space for, at a time. This is a way to regulate usage, so that no single member can get the feeling that they have their own private parking space. The restriction ensures that all members of the group can benefit from the parking spaces.

Any limitations to the booking length possible at any specific parking space will appear as soon as a user selects the desired length of the booking.

 

Time booked

When you book a parking space through Visitors, you need to book a minimum of 30 minutes. If you would like to make a booking lasting longer than 30 minutes, you are also able to book in 15 minute intervals, eg. 45 minutes, 60 minutes and 75 minutes.

 

Personal liability

Entry to and use of parking spaces is at your own risk and in accordance with ParkPrivate ApS’ rules and regulations for use of Visitors and any guidelines posted in the specific parking area. Neither ParkPrivate ApS nor the owner of the parking space can be held liable for accidents, theft, damage to persons, vehicles, valuables and the like, for whatever reason. Likewise, ParkPrivate ApS cannot be held liable for indirect losses or any consequential damages. These rules apply unless something else is stated in non-negotiable legal rules within the Danish law.

 

The parking space is occupied

If, contrary to expectations, it is not possible to park during the booked time, because there are no available parking spaces within the allocated area, it is because one or more vehicles are illegally parked.
ParkPrivate ApS is not responsible for this or the inconvenience it causes.

The parking space is unavailable due to weather conditions etc.

If parking in a booked parking space is not possible or delayed due to unforeseen weather conditions over which ParkPrivate ApS has no control, including - but not limited to - snow, ice, fallen leaves, branches etc. ParkPrivate ApS cannot be held responsible.

 

Parking behind a barrier, boom or gate

If you have booked a parking space which is located behind a barrier, boom or gate (eg. a parking garage), ParkPrivate ApS cannot be held responsible if access to the parking space is not possible, as a result of, for example, technical problems with a barrier or gate. This is the case before, during and after the booking ends.

 

Force majeure

If parking in a booked parking space is delayed or not possible, due to unforeseen circumstances (force majeure) over which ParkPrivate has no control, including - but not limited to - war, mobilization, a pandemic, terrorist actions (including threats), fire, strike, boycott or blockage, lockout, hacking, closure of roads or access to the parking space and or natural disasters, ParkPrivate cannot be held responsible.

 

Law and venue

Any dispute that may arise in connection with terms and conditions of sales and delivery, must be settled according to Danish law.

If disagreements cannot be resolved amicably, any dispute must be settled by arbitration. The arbitration court is located in Aarhus within postal code: 8000-8260. The Arbitration Act Law applies.

 

Parking fine

If you have received a parking fine, this must be paid directly to the operator who imposed the fine. The operator is an independently acting third party, therefore ParkPrivate ApS cannot be held responsible for any action by them.

 

Right of complaint

If you wish to make a complaint about a booking, you can contact ParkPrivate ApS either by sending an email to info@visitors.dk or by calling + 45 71 89 00 07.

If you wish to make a complaint regarding a parking fine, you must directly contact the operator who issued the fine - the operator’s contact information will appear in the printed parking fine, which is either placed on your car or sent to you.

 

GDPR

ParkPrivate ApS will save user information on our servers in accordance with the GDPR regulation and the Danish law on personal data ‘Persondataloven’.

 

Cookies

When visiting http://www.visitors.dk information (so called cookies) will be registered about your visit to the site.

 

Changes

ParkPrivate can at any time make changes to the above mentioned terms and conditions. The applicable terms and conditions at any time are available on the website.

2. For parkeringsgrupper som kræver beboerlicens

Scan of license plates

During entry and exit of a parking garage/ parking area cameras may be used to scan the cars license plate (registration number). The scan will be used to verify that a valid booking has been made, for the car in question, in the Visitors app.
If a valid booking is made for the car with this license plate, the boom barrier will automatically open. This is only if the car arrives within the booked time period. If the car leaves the parking garage/parking area within the time period of the booking, the boom barrier will automatically open. If the car leaves the parking garage/parking area after the booking has ended, payment for the extra time will need to be paid. Payment will occur after you get in contact with the service center of the parking garage/parking area, who will then calculate the time that has exceeded the booking. You will then have to pay the remaining amount before exit of the area with the car is possible.
Any Visitors user who may abuse the system of a parking garage/basement will be banned from any future use.
The license plate scanning cameras are provided and operated by third parties. ParkPrivate ApS is not responsible for the digital validation process carried out through the cameras.

Arrival before a Visitors booking begins

If a user arrives at a parking garage/parking area where payment can be made with Easypark, and the user has made a Visitors booking, the user must be aware of the following:

  • If the user arrives before the start of the Visitors booking, and has activated ‘automatic camera parking’ in the Easypark app, the gate/barrier to the parking garage/parking area will open automatically. This will result in the user activating a paid parking in Easypark and thus paying for the entire parking, which is automatically paid, when the user exits the parking garage/parking area.
  • The same applies, if a user arrives at the parking garage/parking area before the Visitors booking begins and chooses to insert their payment card into the maschine in order to have the boom barrier/gate open. In this case a paid parking is activated and the user will have to pay for the entirety of the parking.

To ensure that it is the user’s Visitors booking that is used, the user must arrive after the Visitors booking has begun. efter Visitors bookingens starttidspunkt.

 

ParkPrivate ApS is not responsible if a user arrives at the parking garage/parking area before the beginning of a Visitors booking and thus activates a paid parking via Easypark’s ‘automatic camera parking’ function or via payment card. ParkPrivate ApS does not provide compensation for paid parking caused by premature arrival at the parking garage/parking area.
